TERMS & CONDITIONS — Monkey Days

These Terms apply to the Days app, created by Elena Tserioti (Thespesio team) (“we”, “us”).

1) Acceptance
By installing or using Days, you agree to these Terms. If you do not agree, do not use the app.

2) The app and your content
Days is a personal note/diary tool. You own the content you create in the app.
You are responsible for what you write and store.

3) Local storage + backups
Days stores your notes locally on your device.
Days may provide export/import features so you can create backup files (e.g., .days).
You are responsible for managing, protecting, and storing your backup files.

4) No cloud service / no guarantees
Days does not provide a cloud service and does not transmit your notes to any server operated by us.
We do not guarantee that the app will be error-free, uninterrupted, or that your data will never be lost or corrupted.

5) Export and import (provided as convenience)
Import and export features are provided as a convenience and may fail, behave unexpectedly, or result in partial or complete data loss. You should keep your backup files secure and consider maintaining more than one copy.

6) As-is / no warranties
Days is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the maximum extent permitted by law.

7) Limitation of liability (including data loss)
To the maximum extent permitted by law, we are not liable for any damages or losses, including:
- loss of data (notes, backups, exports, imports)
- device failure, OS updates, storage issues, corruption, accidental deletion
- third-party storage issues (Files/iCloud Drive/external storage) if you choose to store backups there
- indirect, incidental, special, consequential, or punitive damages

If liability cannot be fully excluded in your jurisdiction, it will be limited to the minimum required by law.

8) Proper use
You agree not to misuse the app, including attempting to reverse engineer or use it in ways that violate applicable laws.

9) Changes
We may update the app and these Terms from time to time. Continued use after an update means you accept the updated Terms.

10) Governing law
These Terms are governed by the laws of Cyprus, excluding conflict-of-law rules, subject to any mandatory consumer protections that apply to you.
